New China Work Permit Policy for Expats

The latest regulation regarding Chinese work permits required by the government will affect all foreigners employed in the Mainland. The authorities have said that the application procedure and the nature of the work permit-will change in the near future. These changes come in order to simplify the process and paperwork, and to increase the quality control imposed on foreigners working and planning to work in China.

The actual current system allows foreigners to apply for two different types of work permits. One is the employment license for foreign employees issued by the Ministry of Human Resources and Social Security. The other is the foreign expert work permit reserved for individuals classified as ‘talented’ in their field, and issued by the State Administration of Foreign Experts Affairs (SAFEA).

What’s New?

The new regulations not only allow applicants to apply online (simplifying and shortening the process), but also combine both work permit types into a single variety.

In addition, every foreigner’s work permit will be graded on a range of A, B, or C according to a points system implemented by the government. According to the Global Times, this points system will numerically grade different aspects such as: educational background, Chinese language proficiency, salary in China, time length worked in China, location, etc… The grading system for foreign workers will follow the following structure:

Type A: Top talent worker. Over 85 points. Type B: Professional worker. Over 65 points. Type C: Unskilled worker. Below 60 points.

Type A worker will have an easier way to get the work permit, while types B and C will encounter more difficulties.

Furthermore, the application procedure can now be done online, which will accelerate the process. In addition, the need to turn in a professional resume has been removed.

When and Where Will It Start?

The new work permit policy will first be tested in certain areas. It will be partially implemented from October 2016 to March 2017 in the cities of Beijing and Shanghai; and provinces of Tianjin, Hebei, Anhui, Shandong, Guangdong, Sichuan

and Ningxia.

According to Gao Xiang, Director of the Administration’s Department of Policies and Regulations. After the trial period, it will fully be implemented nationwide on April 1, 2017.
